Privacy Policy

This Privacy Policy explains how WeAre Services LLC, a New Jersey limited liability company, doing business as WeAre Capture (“WeAre”, “we”, “us”), collects and uses your information when you use the website weare-capture.com and any services we provide through it.

1. Information we collect

When you submit our quote request form, we collect the details you choose to provide:

  • Your name
  • Phone number
  • Email address
  • Project location (city and state)
  • Building or site type
  • Approximate square footage (optional)
  • Deliverables you need and your desired timeline
  • Project description and any notes you add

When you submit the form, we also automatically record your IP address and timestamps (for rate-limiting and basic abuse protection) and basic marketing attribution about how you reached us: campaign parameters (UTM tags), the referring website, the page you landed on, and the page you submitted from.

If you then communicate with us by phone, text message, or email (including if you become a client), we keep the content of those communications and related metadata, such as phone numbers, call times and durations, and message text. See section 3.

If you opt in via our cookie banner, we also use Google Analytics 4 (provided by Google LLC) to understand aggregate site usage: pages visited, referral source, approximate geography derived from IP, and whether visitors start or submit the quote form. No personally identifiable information from the form (name, phone, email, project text) is ever sent to Google. If you decline the banner, Google Analytics stays in cookie-less mode and cannot be used to identify you.

2. How we use your information

We use the information you provide to:

  • Respond to your quote request or support question
  • Contact you about your inquiry and project by phone, text message (SMS), and email
  • Prepare and deliver a proposal for reality-capture / scan-to-BIM work
  • Maintain records of our business relationship if you become a client
  • Protect the service from spam and abuse

3. Calls and text messages

We use Twilio Inc. (a United States company) as our telephony provider to place and receive phone calls and to send and receive SMS text messages with you.

By giving us your phone number, you agree that we may contact you by phone and text message about your inquiry and any resulting project. These are direct business communications, not marketing campaigns. We do not sell or rent your phone number, and we do not share it for anyone else’s marketing.

Message and data rates may apply, and message frequency varies. You can opt out of text messages at any time by replying STOP to any message (reply HELP for help), or by asking us by phone or email to stop contacting you, which we will honor.

Calls may be monitored or recorded for quality, training, and record-keeping. If we record a call in a place whose law requires the consent of everyone on the call, we will tell you at the start of the call. Call metadata (numbers, time, duration, outcome), message text, and any recordings are stored in our system to maintain the history of our relationship with you.

4. How we share your information

We do not sell your personal data. We share it only with the service providers that help us operate, each acting on our instructions:

  • Our own CRM/ERP - we run a self-hosted system on infrastructure we control, where your inquiry and communications are stored as the system of record.
  • Telegram (Telegram FZ-LLC) - a new form submission triggers an internal notification so our team sees it promptly.
  • Twilio Inc. - carries our phone calls and SMS messages with you (see section 3).
  • Resend - delivers transactional email we send to you.
  • Mercury Technologies, Inc. - if you become a paying client, hosts our invoicing and processes invoice payments. We do not store full card numbers.
  • Google LLC - only if you consent to analytics cookies, processes aggregate, de-identified browsing data (not your form submission). Transfers outside the EU/UK are governed by Google’s Standard Contractual Clauses.

We may also disclose information if required by law, subpoena, or to protect the rights and safety of WeAre or others.

5. Data retention

Inquiry records, including related call and message logs, are kept while we are in contact and for a reasonable period afterward (typically up to 24 months from last contact), after which they are deleted or anonymized unless an active engagement or a legal, tax, or accounting obligation requires us to keep them longer. Active-client project data is retained for the duration of the engagement plus 7 years for tax and accounting compliance.

6. Your rights

Depending on your jurisdiction (including under the GDPR and the CCPA), you may have the right to access, correct, delete, or receive a copy of your personal data, and to object to or restrict its processing. You can also opt out of calls, texts, and email at any time. To exercise any of these rights, email privacy@weare-capture.com. We will respond within 30 days.

7. Cookies

This website does not set advertising cookies. Depending on your interaction with the site, your browser may store:

  • wac_consent_v1 (localStorage) - records whether you accepted or declined our analytics cookie banner, so we don’t ask again.
  • glb_loaded (localStorage) - flag that the 3D hero model on the homepage has been loaded at least once, used to skip the loading bar on return visits.
  • Only if you accepted the banner: Google Analytics cookies _ga and _ga_<stream>, used to distinguish users and sessions. These expire after 2 years.

You can clear any of these at any time through your browser’s storage settings. To revisit your choice, clear the wac_consent_v1 entry and reload the page - the banner will reappear.

8. Security

We transmit form submissions over HTTPS and keep credentials for our backend services in server-side environment variables. Access to lead and client records is limited to our team. No method of transmission or storage is fully secure, but we use current best practice to protect the data we hold.

9. Children

Our services are aimed at businesses. We do not knowingly collect personal information from anyone under 18.

10. Changes to this policy

We may update this Privacy Policy from time to time. The “Last updated” date above will change when we do. Material changes will be highlighted on this page.
